    Quick Takeaways

    1. ITC Ruling: The US International Trade Commission found that Insta360 infringed GoPro’s design patent but invalidated other utility patent claims regarding features like stabilization.

    2. Mixed Responses: GoPro expressed satisfaction with the ruling, while Insta360 highlighted that most of GoPro’s claims were dismissed, framing the outcome as a partial victory for them.

    3. Ongoing Sales: Despite the infringement determination, Insta360’s products remain available for sale in the US, as the ruling does not restrict their imports.

    4. Final Decision Pending: A definitive ruling from the ITC is expected on November 10, 2025, potentially impacting the competitive landscape for action cameras.

ITC Finds Insta360 Infringed on GoPro Patents

The U.S. International Trade Commission (ITC) ruled that Insta360 infringed on some of GoPro’s patents. Specifically, GoPro announced that the ITC determined Insta360 violated federal law by importing and selling products that infringe on its intellectual property.

GoPro expressed satisfaction that the ITC validated its design patent related to the Hero camera. Moreover, the ruling reinforced claims regarding GoPro’s HyperSmooth video stabilization feature. However, the ITC did not deem those patents violated.

Insta360, for its part, interpreted the ruling differently. The company pointed out that the ITC rejected most of GoPro’s utility patent claims. Insta360 indicated that the judge found these claims invalid or not infringed. CEO JK Liu commented that the decision reflected a broader industry sentiment: "The future belongs to innovators, not litigators."

Despite the ruling, Insta360 can continue selling its products in the U.S. The ITC’s investigation originated from a complaint from GoPro. The action sought exclusion and cease-and-desist orders to ban imports of Insta360’s cameras.

With a final determination expected on November 10, 2025, the outcome could further impact the action camera market. Although GoPro remains a leading name, Insta360 showcases a growing range of innovative products that appeal to consumers.

The ongoing competition between these two companies highlights a crucial point in technology: innovation drives progress. As both brands evolve, consumers benefit from advancements and choices in the action camera space.
